Do you need a Process Server?

By popular definition, “service of process” is a legal procedure required by courts (or other institutions with the power to judge) to give notice to all parties when facing legal action. Whether you are involved in a civil lawsuit, a small claim, or would like to ensure that you have proof of delivery, a Guilford county process server is the answer for you. Real Estate Cases

 

Real estate cases usually consist of eviction notices, landlord or tenant documents and foreclosure documents. Given today’s economy, eviction cases are not uncommon. A tenant that brakes too many rules on their contract, or is too far behind would warrant an eviction. Being a landlord, evicting a tenant can be downright uncomfortable. You can also spend a number of days waiting for a sheriff to handle it as they tend to have their hands full with other duties. A private process server gets the job done in a timely manner, ensuring there is proof of service to aid in any court procedures in the future. If not eviction notices, summons and complaints are also served to tenants.

Family law cases

 

Family law cases consist of divorce papers, visitation papers, and child support/ custody documents. Such cases can be emotionally charged. This is particularly true for divorces. A good process server shows professionalism, integrity and respect when dealing with such cases. After a filing a complaint, the former spouse needs to be served documents notifying them of the process. The date and time will be recorded. The divorce process cannot move until that step is done. This allows both parties to find a lawyer and guarantee that they cannot object to the course of action later.  

Government and civil cases

 

 Government and civil cases usually come from federal/ local courts, police departments or government agencies. A restraining order is a civil order issued by a court requiring one person to stop harming or harassing another. The purpose of a restraining order is to protect the safety of an individual and restrict contact with them. For a restraining order to be valid it must be served as you cannot be in the distance of the person being served or you would be in violation. A process server would be one of few choices. After a process server serves the documents, the date and time will be recorded. This is used to prove any violations arising from the other party, protecting you.
